The International Fresh Produce Association BB #:378962 alerted members to new tariff rates from the July 31, 2025 Executive Order:
U.S. President Donald Trump signed an Executive Order on July 31 expanding tariff measures against certain trading partners.
The action targets countries the administration says have not sufficiently aligned with U.S. trade and national security priorities since the previous tariffs were announced on April 2.
Key Takeaways:
• New Tariff Rates: Countries listed in Annex I of the Executive Order will be subject to specific tariff rates outlined in the annex. Countries not listed in Annex I will face a default tariff rate of 10%.
• Implementation Date for Tariffs: Tariffs take effect at 12:01 a.m. on August 7, 2025. The duties will apply to goods arriving after 12:01 a.m. August 7 or to goods in transit at that time but arriving after 12:01 a.m. October 5.
• Brazil Tariffs: Brazil will be subject to an additional 10% tariff, in addition to a separate 40% tariff, bringing the total to 50%. The duties will apply to goods arriving after 12:01 a.m. August 6 or to goods in transit at that time but arriving after 12:01 a.m. October 5.
Additional items:
• Canada Tariffs: USMCA Exemption. On August 1, 35% tariffs on non-USMCA compliant goods went effect on Canadian exports to the U.S. Importantly, goods qualifying under the United States-Mexico-Canada Agreement (USMCA), including fresh produce, remain exempt from the tariffs.
• Mexico Tariffs: Mexico received a 90-day pause on any new or additional tariffs as additional negotiations are ongoing. Goods qualifying under the USMCA, including fresh produce, remain exempt from additional tariffs at this time.
• Note: Approximately 15% of goods imported from Canada and Mexico do not comply with USMCA and thus incur the “fentanyl” tariffs.
